Welcome to Four Pillars Media Agency. These Terms & Conditions (“Terms”) govern your use of our website (www.fourpillars.in) and the services we provide. In these Terms, “the Firm”, “we”, “us” and “our” refer to Four Pillars Media Agency, a partnership firm based in Surat, Gujarat; “you”, “your” and “Client” refer to the person or business using our website or engaging our services.

By accessing this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the website or our services.

1. Our Services

We provide branding, digital marketing and related creative services, including (without limitation) social media management, performance marketing, content creation, website development, SEO, design, video production and allied services. The specific scope, deliverables, timelines and fees for any engagement will be set out in a separate proposal, quotation or statement of work agreed between us (“Proposal”). In the event of a conflict, the signed Proposal prevails over these Terms for that engagement.

2. Engagement & Payment

  • Work commences only upon receipt of the agreed advance payment specified in the Proposal.
  • Remaining fees are payable as per the schedule and invoices issued under the Proposal.
  • All fees are exclusive of applicable taxes (including GST), which will be charged additionally.
  • We reserve the right to suspend work, withhold deliverables, or pause campaign management if payments are overdue.
  • Late payments may attract interest and/or suspension of services until cleared.
  • Advance payments are non-refundable to the extent work has commenced or resources have been committed.

3. Advertising Spend

Where we manage paid advertising campaigns:

  • Advertising spend (amounts paid to platforms such as Meta, Google, YouTube and others) is borne entirely by the Client, either funded directly by the Client or routed transparently through us as agreed.
  • Our fees for planning, running and managing campaigns (the “management fee”) are separate from, and in addition to, advertising spend.
  • We are not responsible for platform-side outcomes outside our reasonable control, including account suspensions, ad disapprovals, policy changes, pricing changes or algorithm updates.
  • While we apply professional skill and effort, we do not guarantee specific results, returns, rankings, reach or sales, as these depend on factors beyond our control.

4. Client Responsibilities

To deliver effectively, we rely on you to:

  • Provide accurate, complete and timely information, content, access and approvals.
  • Ensure any material you supply (text, images, logos, products) does not infringe third-party rights and that you hold all necessary licenses and consents.
  • Respond to requests for feedback and approvals within reasonable timeframes; delays on your side may affect timelines.

You agree to indemnify us against claims arising from material you supply or instructions you give us.

5. Approvals & Revisions

Deliverables are produced based on the brief and the rounds of revision specified in the Proposal. Additional revisions, changes of scope, or new requests beyond the agreed scope may be chargeable. Work approved by you is deemed accepted.

6. Intellectual Property

Unless expressly agreed otherwise in writing:

  • The Firm retains ownership of all intellectual property it creates, including designs, creative concepts, source files, working files and underlying methods.
  • Upon full payment, the Client is granted a non-exclusive, perpetual license to use the final delivered assets for the agreed commercial purpose.
  • Source files, editable/working files and unused concepts remain the property of the Firm and are not included unless specifically purchased.
  • The Firm retains the right to display and reference completed work in its portfolio, case studies and marketing, unless confidentiality is agreed in writing.
  • Any third-party assets (stock, fonts, music, plugins) remain subject to their respective licenses.

7. Confidentiality

Both parties agree to keep each other’s non-public business information confidential and to use it only for the purpose of the engagement. This obligation survives the end of the engagement.

8. Term & Termination

  • Either party may terminate an engagement with written notice as specified in the Proposal.
  • On termination, the Client shall pay for all work completed and resources committed up to the termination date.
  • Fees and advances already paid are non-refundable to the extent work has been performed.
  • Clauses relating to payment, intellectual property, confidentiality and liability survive termination.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or in connection with any engagement shall not exceed the total fees actually paid by you to us for that engagement. We shall not be liable for indirect, incidental or consequential losses, including loss of profit, revenue, data or goodwill. Nothing in these Terms limits liability for fraud or for any liability that cannot be excluded under applicable law.

10. Website Use & Intellectual Property

All content on www.fourpillars.in is owned by or licensed to the Firm and is protected by law. You may view it for personal, non-commercial use. You must not republish, sell, reproduce, redistribute or exploit our website content without our written permission. You must not create frames around our pages or misrepresent your relationship with us.

11. Third-Party Links

Our website may link to third-party websites for convenience. We do not control and are not responsible for their content, accuracy or practices. Accessing them is at your own risk.

12. Disclaimer

Our website and its content are provided “as is”. To the maximum extent permitted by law, we exclude all warranties relating to the website and do not guarantee that it will always be available, error-free or up to date. Nothing in this disclaimer excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts at Surat, Gujarat. While we serve clients internationally, this governing law and jurisdiction apply to all engagements unless otherwise agreed in writing.

14. Changes to These Terms

We may amend these Terms from time to time. The current version will always be posted on this page with an updated date. Continued use of our website or services after changes indicates acceptance of the revised Terms.
